Terms and Conditions at Branxholm Park House

Your reservation is for a one or two night stay depending upon the date and package chosen.

Your contract is between you and the owners of Branxholm Park, David and Deborah Knaggs and is subject to the following conditions.

1. PERSONAL DETAILS

Information you provide to Branxholm Park is for the purpose of your forthcoming reservation only and will not be shared with any third party.

2. WEB SITE

The property is accurately represented on our website. The owners reserve the right to make changes to the interior and exterior of the property at any time but not during your wedding event.

3. YOUR STAY

You can arrive at Branxholm Park after 3pm if staying the night before your wedding event or 11am if your package if just for one night. Please do not arrive at any stage before this as there may be other people using the property. If you anticipate arriving much later than you stated arrival time, please let us know. On the morning after the wedding, you must have fully vacated the property and gardens before 11am.
 
You agree to keep the house and grounds in a reasonably tidy order. Any additional cleaning of the property following your departure, beyond the normal amount reasonably required, may be charged as extra and deducted from your Good Housekeeping Deposit.

The numbers in your party must never exceed the stated house capacity of 16 and 6 additional children unless you have prior agreement with the owners. The wedding day between 1pm annd 1am  will be an exception to this and numbers must be clarified by written agreement prior to your stay.

Conduct at the Wedding

The party who makes the booking with us is responsible for the behaviour and actions of all guests during their stay at Branxholm Park. Inappropriate behaviour may result in the event being stopped early or cancelled and guests being asked to leave the premises. Any damage caused by a guest is the responsibility of the named booking individuals and must be settled in agreement with the owner of Branxholm Park. The responsibility to inform all guests of the Terms and Conditions at Branxholm Park lies with the individual named on the booking form.

There is a Good Housekeeping Deposit payable to the owners of Branxholm Park no less than two weeks prior to your wedding event. The Good Housekeeping Deposit is £1,000 and is payable by BACS transfer. The Good Housekeeping Deposit will be used by the owners of Branxholm Park in the event of damage to the property, including fixtures and fittings, having taken place during your stay. In the event of no damage being done the Good Housekeeping Deposit will be returned by the owners of Branxholm Park to you within seven days of your stay.

You must ensure that no furniture is moved nor is anything nailed, screwed or adhered in any way to any wall, door or other part of the building unless prior permission is granted by the owners.

The owners of Branxholm Park reserve the right to impose a penalty of £100 PER GUEST PER NIGHT for any NON-RESIDENT GUESTS WHO STAY OVERNIGHT during the booking and /or who exceed the agreed occupancy levels.

Guests attending the wedding event but not residing at Branxholm Park are asked to leave the premises by 1am and all evening entertainment must cease before 1 am. (Unless there are government restrictions asking for hospitality to end earlier, such as during a pandemic) The swim-spa, facilities at Branxholm Park cn only be used by children if supervised by adults at all times. These facilities are also only for the use of those guests staying overnight at Branxholm Park and are not available for other event guests.

The swim-spa, will be closed at 10pm on the night before the wedding, and at 12 noon on the day of your wedding event and will be reopened the following morning on request from 8.30am. 

The use of fireworks or Chinese lanterns is prohibited at any time during your wedding event. 

Dogs are not allowed on beds or soft furnishings and must not be left unattended on the premises at any time. This means that is you choose to bring dogs, they can not be locked in a room alone at any stage. There is a £30 charge per pet charge per booking.

Fuel Included

Fuel is included in your rental at Branxholm Park, but this does not mean unlimited. Central heating systems will be set on timers for certain periods of the day to keep the house acceptably comfortable in all seasons. Wood is provided for an evening fire. 

4. SMOKING

Branxholm Park is non-smoking and this includes the swim spa and loggia. If smoking is detected following your stay the full Good Housekeeping Deposit will be withheld.

5. INTERNET SERVICES

Branxholm Park has internet but because of our location the quality of your connection is not guaranteed.

6. YOUR RESERVATION

You must be 21 years or over when you book this accommodation and must be staying at the property. The owners have the right to refuse any reservation prior to the issuing of any confirmation in writing. When you receive your confirmation, you must check all the details carefully for accuracy and contact the owners immediately if you find any discrepancy.

7. RENTALS AND CHARGES

Reservations are confirmed when details have been checked and approved by the Branxholm Park Reservations Office. For those reservations made within six months and twelve months of the wedding event a 30% Hold the Date Deposit is payable immediately. The balance is due no less than six months prior to the wedding event. For those reservations made more than a year in advance there is a Hold the Date deposit payable in two parts. Firstly, a 10% deposit payment is payable immediately upon reservation. Payment is possible by BACS, Debit card or Credit card to secure a reservation. On receipt of your deposit Branxholm Park will confirm your reservation by email (or post). Secondly, a further 20% deposit is payable no later than 6 months from the date of your initial 10% deposit payment. The remaining balance is due no less than 6 months prior to your arrival, unless by prior written agreement. If your booking is for a date within six months of the wedding event, you are required to pay the full rental in one payment.

8. CHANGES TO RESERVATIONS BY YOU

Should you wish to cancel your reservation or change to another date once the owners of Branxholm Park have issued confirmation of your reservation , this may be treated as a cancellation which would then be subject to the cancellation charges as outlined below. Branxholm Park will advise you of the cancellation policy and you will have the option to continue with your first reservation.
The cancellation policy is as follows

• Deposits are non-refundable
• If you cancel between 6 months and 12 months of the confirmed date of the booking 75% of the Wedding package fee is still due to be paid to the owners in accordance with the Terms and Conditions.
• If you cancel with less than 6 months to go to the confirmed date of the booking then 90% of the wedding package fee is still due to be paid to the owners in accordance with the charges as laid out in the Terms and Conditions.

9. Events outside our control

We shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under our contract with you that is caused by events outside our reasonable control (such as serious damage to the venue, serious adverse weather conditions, or interruption or failure of utility services such as electric power or water). In these circumstances, we shall use every effort to notify you as soon as is reasonably practical. If, as a result of such events, we believe we have no alternative but to cancel your booking, you must have suitable wedding insurance to cover you for these eventualities.

If your booking is impacted by a Pandemic or Epidemic and as such we are unable to open Branxholm Park due to government restrictions or the restrictions placed upon us to comply with safety requirements or other changes in law or relevant codes of practice, mean that we are unable to deliver our Wedding Package we will in the first instance look to offer an alternative date.

We will use all reasonable endeavours to ensure that no components of your wedding have to be altered. However, as a wedding plan is normally put together a long time before your scheduled date, we reserve the right to make changes to certain components if this is necessary to comply with safety requirements or other changes in law or relevant codes of practice.

We are not liable for changes that may be imposed by Government that impact on the ability of outside suppliers contracted by yourselves to attend the wedding as these are out with the package offered by Branxholm Park.

We will also not be liable for Government policy which impacts on attendance at the wedding such as travel restrictions.

We will notify you of any significant changes but unless the change is one which is likely to fundamentally change the nature of the wedding package offered by ourselves we will not offer a refund, costs or compensation.

10. RESERVATION CANCELLATION OR ADJUSTMENT BY US

We the owners at Branxholm hope that it does not have to either cancel or adjust your reservation in any way: however, as unforeseen problems do occur, excluding items identified in paragraph 8 we would contact you immediately to discuss any proposed cancellation or adjustment. If the circumstances affect your desired booking, we will endeavour to find you an alternative date. If the alternative is unacceptable to you, we will refund all your package paid to that point but will not be liable for any other costs incurred by you. Except where otherwise expressly stated in these conditions, the owners at Branxholm shall not be liable for changes beyond their control.

11. CANCELLATION BY YOU. PLEASE ENSURE THAT YOU ARE PROTECTED BY CANCELLATION INSURANCE

If you have to cancel your reservation you must telephone Branxholm Park on the number shown on your booking confirmation as soon as the reason for the cancellation occurs. You must also confirm your cancellation by post or by email. The day on which we receive the telephone cancellation is the day on which your reservation is cancelled.

Please note that should you cancel your reservation prior to the balance due date, the balance remains payable by you in accordance with the cancellations policy. If you have paid in full you have the right to reinstate your booking up to one month before. If you opt to reinstate your reservation an administration fee of £25 will be charged.

12. COMPLAINTS

Branxholm Park hope that you will not have any cause for complaint but in the event of a problem arising contact the owners at Branxholm Park immediately so that any problem may be resolved. The Owners must be given the opportunity to rectify the problem. If, after this, you feel that the problem was not resolved then you must, within 7 days of the end of your wedding event, put your complaint in writing to the owners.

13. LIABILITY

In signing the booking form, you agree that as the named person on the booking fee you are liable for any damage caused during your stay to the house, ground or animals by any of your party. You also agree that the use of the house by your party and its facilities is at your own risk and you agree to abide by the age restrictions in place for all leisure facilities. Please be aware that footpaths can be uneven and care must be taken especially outside the house with steps and slopes which may be slippery if wet.

14. LAW

The contract between you and Branxholm Park is subject to the exclusive jurisdiction of the Scottish Courts and is formed in Hawick, Scottish Borders, Scotland. The Terms and Conditions above were published in August 2018 and are valid until August 2022. The owners of Branxholm Park reserve the right to vary the terms and conditions at any time.
